Terms of Service

These Terms of Service (“Terms”) govern your access to and use of mysalondoll.com, mysalondollshop.com, our Shopify-powered store and checkout, and any other website, feature, or service that links to these Terms (collectively, the “Services”).

The Services are operated by My Salon Doll, doing business as My Salon Doll (“My Salon Doll,” “we,” “us,” or “our”).

By accessing or using the Services, creating an account, or placing an order, you agree to these Terms and to our Privacy Policy, Shipping Policy, and Return and Refund Policy, which are incorporated into these Terms by reference.

If you do not agree to these Terms, please do not use the Services.

Eligibility

The Services are intended primarily for adults purchasing products for themselves or others.

To make a purchase, you must either:

  • Be at least the age of majority in the jurisdiction where you live, or

  • Use the Services with the involvement and permission of a parent or legal guardian who agrees to these Terms.

Although My Salon Doll products may be designed for children, our ecommerce Services are not directed toward children under 13.

If you allow a minor to use a product purchased through the Services, you are responsible for providing appropriate supervision and ensuring that the product is used according to applicable instructions, warnings, and age guidance.

Product Information

We make reasonable efforts to describe and display our products accurately.

However, product appearance may vary from what you see on your device because of factors including:

  • Screen settings

  • Lighting

  • Photography

  • Manufacturing variation

  • Packaging changes

  • Material characteristics

  • Product updates or improvements

Unless specifically stated otherwise, dimensions, measurements, colors, and other product characteristics are approximate.

We may update product descriptions, packaging, specifications, or included accessories from time to time without materially changing the basic nature of the product.

Dolls, Hair Styling, and Product Care

My Salon Doll products may be designed for activities involving doll hair styling, brushing, braiding, accessories, washing, or other pretend salon play.

Please follow all instructions, warnings, age recommendations, and care guidance provided with the product or made available by My Salon Doll.

Adult supervision may be appropriate depending on the child's age and the activity being performed.

Heat and Styling Tools

Do not use household curling irons, straighteners, hair dryers, or other heated appliances on a My Salon Doll product unless the applicable product instructions specifically state that such use is permitted.

Any styling tool included with or marketed for a My Salon Doll product should be used only according to its instructions and intended purpose.

Adults are responsible for supervising children when activities involve:

  • Styling tools

  • Water

  • Hair products

  • Small accessories

  • Electrical products

  • Any item that could reasonably require adult supervision

Using products or styling tools contrary to their instructions may damage the product and may affect eligibility for a discretionary return.

Nothing in this section limits rights that apply when a product arrives damaged or defective.

Prices and Availability

Product prices, inventory, promotions, shipping options, and availability may change at any time before an order is placed.

Prices displayed on the Services do not necessarily include:

  • Shipping charges

  • Sales or use taxes

  • Customs duties

  • Import fees

  • Other applicable charges

Any applicable amounts that we collect will be displayed during checkout when reasonably possible.

We reserve the right to limit quantities or discontinue products without notice.

Orders

Submitting an order through the Services constitutes an offer to purchase the products in that order.

Receiving an automated order confirmation does not necessarily mean that we have accepted the order.

We may accept, decline, limit, or cancel an order when reasonably necessary, including because of:

  • Product unavailability

  • Inventory errors

  • Pricing or description errors

  • Payment authorization problems

  • Suspected fraud

  • Shipping restrictions

  • Quantity limitations

  • Promotional misuse

  • Technical errors

  • Other circumstances that prevent us from reasonably fulfilling the order

If we cancel an order after payment has been successfully processed, we will issue an appropriate refund to the original payment method.

Accuracy of Customer Information

When placing an order, you agree to provide accurate and complete information, including:

  • Name

  • Billing information

  • Shipping address

  • Email address

  • Telephone number, when requested

  • Payment information

You are responsible for reviewing your order information before completing checkout.

We are not responsible for delays or delivery problems resulting from inaccurate or incomplete information provided by you, subject to applicable law.

Payment

By submitting payment information, you represent that you are authorized to use the selected payment method.

You authorize Shopify, its payment providers, or another applicable payment processor to charge the amounts displayed during checkout, including applicable taxes and shipping charges.

Payment processing may be subject to additional terms and privacy practices of the payment provider.

We do not generally receive or store your complete payment-card number.

Promotions, Discounts, and Coupons

From time to time, My Salon Doll may offer:

  • Discount codes

  • Promotional pricing

  • Free-shipping offers

  • Product bundles

  • Giveaways

  • Limited-time sales

  • Other promotional offers

Promotions may have separate terms regarding:

  • Eligibility

  • Start and end dates

  • Minimum purchase requirements

  • Excluded products

  • Geographic availability

  • Quantity limits

  • Redemption limits

Unless specifically stated otherwise:

  • Promotions cannot be combined.

  • Discounts have no cash value.

  • Promotions apply only during the stated promotional period.

  • A promotion may be modified or discontinued before an order is placed.

  • Promotional discounts cannot be applied retroactively to previous purchases.

We may reject or cancel orders involving fraudulent, abusive, automated, or otherwise improper use of a promotion.

Shipping

Shipping is governed by our Shipping Policy.

Shipping dates and carrier delivery estimates are generally estimates rather than guaranteed delivery dates unless expressly stated otherwise.

Shipping delays may occur because of events outside our reasonable control.

Returns, Exchanges, and Refunds

Returns, exchanges, cancellations, and refunds are governed by our Return and Refund Policy.

Eligibility may depend on factors including the condition of the product, how it has been used, and how much time has passed since delivery.

In particular, dolls whose hair has been cut, colored, washed, treated, or styled with heat may be considered used and may not qualify for a discretionary return as described in our Return and Refund Policy.

Shopify and Other Service Providers

Our Services may use Shopify and other third-party providers for functions including:

  • Product listings

  • Shopping carts

  • Checkout

  • Payments

  • Order management

  • Website hosting

  • Analytics

  • Advertising

  • Customer communications

  • Fulfillment and shipping

Your use of certain third-party services may also be subject to the terms and privacy policies of those providers.

We are not responsible for third-party services except to the extent required by applicable law.

Customer Accounts

If we offer customer accounts, you are responsible for maintaining the confidentiality of your account credentials and for activity occurring through your account.

You agree to notify us if you reasonably believe that your account has been accessed or used without authorization.

We may suspend or restrict an account when reasonably necessary to protect customers, prevent fraud, enforce these Terms, or maintain the security of the Services.

Reviews, Photos, and Other User Content

The Services may allow customers to submit content such as:

  • Product reviews

  • Comments

  • Photos

  • Videos

  • Testimonials

  • Feedback

  • Questions

You retain ownership of content that you create.

However, by voluntarily submitting content to us for publication or promotional use, you grant My Salon Doll a non-exclusive, worldwide, royalty-free license to use, reproduce, display, format, and distribute that content in connection with operating, promoting, and improving My Salon Doll and the Services, to the extent permitted by law.

You represent that you have the rights necessary to submit the content.

You may not submit content that:

  • Infringes another person's intellectual-property or privacy rights.

  • Contains unlawful, threatening, abusive, or defamatory material.

  • Contains malicious software or harmful code.

  • Misrepresents your experience with a product.

  • Contains confidential information belonging to another person.

  • Is fraudulent, deceptive, or intentionally misleading.

We may remove or decline to publish user content at our discretion, subject to applicable law.

Intellectual Property

The Services and their content are owned by, licensed to, or otherwise lawfully used by My Salon Doll and are protected by applicable intellectual-property laws.

Protected content may include:

  • The My Salon Doll name and branding

  • Logos

  • Product names

  • Product designs

  • Photographs

  • Videos

  • Illustrations

  • Graphics

  • Written copy

  • Website layouts

  • Page designs

  • Icons

  • Software

  • Marketing materials

You may access and use the Services for personal, noncommercial shopping purposes.

Except as permitted by law or with our prior written authorization, you may not:

  • Copy or reproduce our content.

  • Modify or create derivative works from our content.

  • Republish or distribute our content.

  • Sell or commercially exploit our content.

  • Scrape or systematically extract content or data.

  • Use our photographs or videos to market unrelated products.

  • Frame or mirror substantial portions of the Services.

  • Use My Salon Doll trademarks or branding in a way that suggests an unauthorized relationship.

No ownership rights are transferred to you through your use of the Services.

Acceptable Use

You may not use the Services to:

  • Violate any applicable law or regulation.

  • Commit fraud or facilitate fraudulent activity.

  • Interfere with the security or operation of the Services.

  • Attempt unauthorized access to systems, accounts, or information.

  • Introduce malware, viruses, or other malicious code.

  • Probe or test vulnerabilities without authorization.

  • Circumvent security or access controls.

  • Use bots or automated systems to place abusive or unauthorized orders.

  • Scrape or systematically collect content or customer information without permission.

  • Submit intentionally false or misleading information.

  • Impersonate another person or organization.

  • Violate another person's intellectual-property, privacy, or other legal rights.

  • Harass, threaten, or harm others.

  • Abuse promotions, discounts, return policies, or payment systems.

We may restrict, suspend, or terminate access to the Services when we reasonably believe these Terms have been violated or when necessary to protect My Salon Doll, our customers, or our service providers.

Resale and Commercial Use

Unless otherwise authorized by us in writing, purchases through the Services are intended for personal or legitimate gift use.

You may not use My Salon Doll branding, images, trademarks, or marketing materials in a way that falsely suggests that you are:

  • An authorized retailer

  • An official distributor

  • A representative of My Salon Doll

  • Affiliated with or endorsed by My Salon Doll

Nothing in this section prohibits lawful resale rights that cannot be restricted under applicable law.

Third-Party Links

The Services may contain links to third-party websites, social media platforms, payment services, or other resources.

We do not control those third parties and are not responsible for their:

  • Content

  • Availability

  • Security

  • Privacy practices

  • Terms

  • Products or services

Your interactions with third parties are governed by their respective terms and policies.

Errors and Inaccuracies

Occasionally, the Services may contain typographical errors, inaccurate information, or omissions relating to:

  • Product descriptions

  • Prices

  • Promotions

  • Availability

  • Shipping charges

  • Delivery estimates

We reserve the right to correct errors and update information.

If a material error affects an order you have already submitted, we may contact you with available options, which may include confirming the corrected information or canceling the affected order and issuing a refund.

Electronic Communications

When you use the Services, place an order, or contact us electronically, you consent to receive communications related to your transaction or use of the Services electronically.

These may include:

  • Order confirmations

  • Payment confirmations

  • Shipping notices

  • Customer-service communications

Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis.

We do not guarantee that:

  • The Services will always be available or uninterrupted.

  • Website content will always be error-free.

  • Every device or browser will display the Services identically.

  • Third-party services will always operate without interruption.

To the maximum extent permitted by law, we disclaim implied warranties relating to the Services, including implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement.

This disclaimer does not eliminate:

  • Any express product warranty or promise we specifically make.

  • Rights relating to defective or unsafe products that cannot legally be waived.

  • Consumer protections that apply under applicable law.

Limitation of Liability

To the maximum extent permitted by applicable law, My Salon Doll and its owners, employees, affiliates, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to use of the Services.

Where liability may lawfully be limited, our total liability for a claim arising directly from an order or use of the Services will not exceed the amount you paid for the product or order giving rise to that claim.

These limitations do not apply:

  • Where prohibited by law.

  • To liability that cannot legally be excluded or limited.

  • To any consumer-protection rights that cannot legally be waived.

Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless My Salon Doll and its owners, employees, affiliates, and representatives from third-party claims, liabilities, losses, and reasonable costs arising from:

  • Your unlawful use of the Services.

  • Your material violation of these Terms.

  • Content you submit that violates another person's rights.

This provision does not require you to indemnify My Salon Doll for conduct for which indemnification cannot legally be required.

Governing Law

These Terms are governed by the laws of the State of Utah and applicable federal law, without regard to conflict-of-law principles.

However, nothing in these Terms is intended to deprive a consumer of protections that apply under the laws of the consumer's place of residence and cannot legally be waived by contract.

Changes to the Services

We may modify, suspend, discontinue, replace, or update portions of the Services from time to time.

We are not obligated to continue offering every feature, product, promotion, or service indefinitely.

Any accepted orders will continue to be handled according to applicable law and the terms that applied to the transaction.

Changes to These Terms

We may update these Terms periodically to reflect changes in:

  • Our business

  • Products or Services

  • Technology

  • Legal requirements

  • Ecommerce practices

When we update these Terms, we will revise the Effective Date at the top of this page.

Revised Terms apply from the posted effective date.

Changes will not retroactively alter the material terms of an order that we have already accepted unless required by law or agreed to by you.

Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law.

The remaining provisions will continue in effect.

No Waiver

Our failure to enforce any provision of these Terms does not waive our right to enforce that provision or another provision later.

Entire Agreement

These Terms, together with policies incorporated by reference—including our Privacy Policy, Shipping Policy, and Return and Refund Policy—form the agreement governing your use of the Services to the extent applicable.
